Privacy Policy

This Privacy Policy explains how the operator of LureMark AU (LureMark, we, us or our) collects, uses, discloses and protects your personal information. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

By using LureMark you consent to the handling of your personal information as described here. This policy works alongside our Terms of Use.

1. What personal information we collect

Depending on how you use LureMark, we may collect:

  • Account details — username, email address and password (passwords are stored in hashed form by our authentication provider, not in readable form).
  • Profile details — display name, bio, avatar photo and home state, if you provide them.
  • Your content — catch records (species, measurements, photos, notes), fishing spots and waypoints, posts, comments and messages.
  • Location information — approximate or precise location when you use location features (for example detecting conditions for your spot or logging where a catch was made). Photos you upload may contain location and time information (EXIF) that the app can read to pre-fill a catch; you control whether a precise location is saved or kept private.
  • Device & security information — for sign-in and account-security events we record your IP address and device/operating system to detect unauthorised access and fraud.
  • Usage information — how you use features of the app (for example which screens you open), used to run and improve the Service.
  • Marketplace information — if you use the Tackle Shop: listings, item details, your town, and messages with other users.
  • Payment information — if you subscribe to Pro, payments are processed by our payment provider (Stripe). We do not receive or store your full card number; we are told only whether your subscription is active.
  • Support & communications — messages, help requests and any screenshots or diagnostic snapshots you choose to send us.

2. How we collect it

  • Directly from you, when you create an account, set up your profile, log catches, post, message or contact us.
  • Automatically, as you use the app — including device/security information at sign-in and general usage information.
  • From your device, with your permission — such as camera, photos (including their embedded location/time), and GPS location.
  • From third parties who help us provide the Service (for example our payment provider tells us your subscription status).

3. Why we use your personal information

  • To provide, maintain and personalise the Service — your logbook, spots, conditions, feeds, competitions and medals.
  • To power features you ask for, including AI features (fish identification, the Fishing Assistant and Insights) and location-based conditions.
  • To keep the Service and your account secure, and to detect and prevent fraud, abuse and unauthorised access.
  • To understand and improve how the app is used, and to fix problems.
  • To communicate with you — service messages, notifications you have enabled, and responses to your help requests.
  • To comply with our legal obligations and to establish, exercise or defend legal claims.

4. AI & automated features

When you use AI features, relevant information — such as a photo, your location, current conditions and elements of your catch history — is sent to our AI service providers to generate a result (for example a species suggestion or a tactics answer). These features are aids only, can be wrong, and are not used to make decisions that have legal or similarly significant effects on you. See the Terms of Use for the limits on relying on them.

5. What other users can see

LureMark is partly social. Your username, display name, avatar and any content you choose to share (posts, catches shared to a group or the public feed, leaderboard entries, marketplace listings and messages to the person you are dealing with) are visible to other users as described in the app. By default your catches are private to you until you share them. Precise catch and spot locations are kept private — other users see only the general area (such as a suburb) where you choose to share it.

6. When we disclose your information

We do not sell your personal information. We may disclose it to:

  • Service providers who help us run LureMark — such as cloud hosting and database, our payment provider (Stripe), AI providers, push- notification delivery, analytics and error monitoring — under obligations to protect your information and use it only to provide their service to us.
  • Other users, to the extent you share content publicly or with a group, or message them (see section 5).
  • Authorities or third parties where required or authorised by law, or to protect the rights, safety or property of LureMark, our users or the public.
  • A successor, if LureMark or its assets are involved in a business sale, merger or restructure — subject to this policy.

7. Overseas disclosure

Some of our service providers are located, or store data, outside Australia — including in the United States. Where we disclose personal information overseas, we take reasonable steps to ensure it is handled consistently with the APPs. By using the Service you acknowledge that your information may be stored and processed overseas.

8. Sign-in security logging

For your security we record sign-in events — including IP address and device — to detect unauthorised access. This security data is used for fraud prevention only, is accessible only to authorised administrators, is retained for 180 days and then automatically deleted, and is removed entirely if you delete your account. Ordinary in-app activity is not tracked in this way.

9. How we store and protect your information

We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure — including encryption in transit, access controls and hashed passwords. No system is completely secure, so we cannot guarantee absolute security; tell us promptly if you believe your account has been compromised.

10. Retention & deletion

  • We keep personal information for as long as needed to provide the Service and for legitimate legal, security and operational reasons.
  • You can delete your account from within the app or by contacting us. On deletion we permanently delete your personal data within 30 days, except where we are required to retain some information by law. Catches you shared into groups may be anonymised rather than removed, so shared leaderboards stay consistent.
  • Security sign-in logs are auto-deleted after 180 days (see section 8).

11. Accessing & correcting your information

You can view and update much of your information directly in the app (profile, content, settings). Under the APPs you may also request access to the personal information we hold about you, and ask us to correct it if it is inaccurate. Contact us using the details below — we will respond within a reasonable time, and will let you know if an exception means we cannot fully meet your request.

12. Notifications & marketing

Push and other notifications are opt-in and can be turned off at any time in Settings or through your device. We focus on service and activity notifications; we will not send you marketing messages without a way to opt out.

13. Cookies & on-device storage

LureMark uses cookies and on-device storage to keep you signed in, remember your preferences, and enable offline features (such as cached maps and queued catches). Blocking these may stop parts of the app from working.

14. Children

LureMark is not intended for children under 16. If you are under 16 you should use LureMark only with the involvement of a parent or guardian. If you believe a child has provided us personal information without appropriate consent, contact us and we will take reasonable steps to delete it.

15. Complaints

If you have a privacy concern or complaint, contact us first (details below) and we will try to resolve it. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or 1300 363 992.

16. Changes to this policy

We may update this Privacy Policy from time to time. If we make material changes we will take reasonable steps to notify you (for example in-app) and update the “Last updated” date above. Continuing to use LureMark after a change takes effect means you accept the updated policy.
